Why am I still on 192.com after opting out of being on the edited register?

Last year I opted out of being on the edited register yet I find my name and address on 192.com. Can I get this removed, and is the council liable?

The issue with 192.com and other people-finding services is a common one. The reason your details appear on such websites is that they can use any version of the edited register on which you name appears. If, for the sake of argument, you first opted out in 2008 and have been opted out ever since they would still be able to use your personal data as it appeared on versions of the register published before 2008. Worse, the edited register is relative young; before 2002 companies could use the full electoral register as a commodity. 192.com and other people-finding service are legally allowed to sell your personal details as they appeared on any version full electoral roll before 2002 (and that's exactly what they do).

There has been debate in Parliament about whether or not this loophole can be closed. Government reckoned that nothing could be done to stop the dubious business practices of the likes of 192.com. At the same time people who asked people-finding websites to remove their personal details found that their requests were simply ignored. Thankfully, the Information Commissioner's Office ruled in 2006 that ignoring removal requests was a breach of the Data Protection Act, and as a result it is now possible to get your personal data removed from 192.com by completing a record removal form.
